PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE.IT IS THE RESPONSIBILITY OF YOU, THE USER, CUSTOMER, OR PROSPECTIVE CUSTOMER, TO READ THESE TERMS AND CONDITIONS BEFORE PROCEEDING TO USE THE SITE AND SERVICES. IF YOU DO NOT AGREE TO ALL TERMS AND CONDITIONS THEN PLEASE DO NOT ACCESS OR USE THIS SITE OR SERVICES.

★ By commissioning me, I accept that you have read through my Terms and Service and agree to it. Thus you cannot plead negligence.

The present terms and conditions is a legal agreement between you and Courtzgarden.

Overview:

  • By visiting the site/or purchasing from us, you engage in our "Service" and agree to be bound by the following conditions and terms including those terms, conditions, and policies herin and or available by a hyperlink.

  • These terms apply to all users without limitation who are browsers, vendors. customers, merchants and or contributors of content.

  • Any new features or tools which are added shall be subject to the Terms. You can review the current Terms at any time. We, Courtzgarden, reserve the right to update, change or replace any part of these Terms by posting updates or changes to our site and services.

  • It is your responsibility to check this page periodically for changes. Your continued use of access to the site following the post of any changes constitutes acceptance of those changes.


I. General Terms: Art Commission Agreement

  • Between CourtzGarden (herein referred to as The Artist) and the Commissioner (herein referred to as The Client).

  • You the Client agree and attest that you are 18 years of age or older to agree to these terms.

  • Timeline: The commissioned work shall take 8 weeks to complete.

  • The Client and Artist agree to the following scope of the work:

  • Week 1: Introduction (review idea and layout)

  • Week 2: Sketching begins

  • Week 3: Check-in - the sketch will be revealed for review and alterations are accepted at this stage

  • Week 4: Sketch will be turned into line art and changes will be worked in. Coloring begins

  • Week 5: Check-in. Line phase and coloring is completed and ready for review. Minor changes are accepted at this stage.

  • Week 6: Details, shadows and highlights are then added.

  • Week 7: Final check in for any further small changes before completion.

  • Week 8: The Artist shall present the final artwork to the client virtually or in person for final review

  • Revisions: It is the Clients responsibility to communicate with the Artist regarding any discrepancies between the scope of the work and artwork execution. This agreement has dedicated regular intervals in which the Artist will communicate with the Client to complete the commissioned artwork to the Client’s standards.

  • The Client is entitled to two (2) reasonable revisions.

  • The Artist cannot offer major revisions on artwork commissioned in the following mediums:

  • acrylic and oil paints, sculpture, textiles, complex mixed media, or other labor-intensive mediums under the Artist’s discretion.

  • Any revisions requested that are not the Artist’s fault and were not requested during check-in’s shall be billed to the Client at the rate of ($13.50) per hour.

  • Following the Client's acceptance of the final Artwork, the Client shall not alter the Artists original artwork themselves or by a third party under any circumstances. The client shall allow the artist to make the alterations. The Artist agrees to accommodate requested alterations to the best of their ability.

  • Payment: Paying full price or a deposit of 50% of the total price of the commissioned work shall be due before work can begin. Upon the Clients final inspection and acceptance. Any remaining balance is due.

  • Past due payments will incur a (2%) interest each week payment is due. If the Artist must take legal action to acquire final payment, the Client shall pay all of the Artist’s legal fees.

  • Delivery: The Artist shall deliver the final work once the Client pays any remaining balance or accepts the artwork.

  • For digital work the Artist shall deliver the final artwork in the following formats:

  • (Example: .jpeg, .png , .pdf , .psd)

  • For printed or three-dimensional artwork, the Artist shall take reasonable care in delivering the final artwork either in person or via mail. Shipping fee's may apply.

  • Rights to Assets:

  • The artist, Courtzgarden, retains a portion of the intellectual property of all artworks. Therefore the following guidelines are in place:

  • * The Artist retains the right to display any artwork created for promotional purposes.

  • * The Artist may publish artwork to social media and other internet platforms for promotional purposes.

  • * The Artist may not sell prints of any artwork without the consent of the client.

  • * The Artist retains the rights to the PSD original files.

  • Any alterations to these guidelines must be agreed upon, in writing, and signed by both parties if any artworks are to be published or if the Artist is compensated by a third party for the assets created for the Client.

  • * The Client may not claim the artwork as their own.

  • * The Client may not utilize the artwork, nor any assets of the project for NFT's or AI.

  • * The Client must credit the Artist, Courtzgarden, when sharing or displaying the artworks in any venue, including but not limited to: Social Media websites and platforms.

  • * The Client may not publish the artworks without permission of the artist, Courtzgarden.

  • * The Client shall be given completed assets in JPEG or PNG formats.

  • Termination: If the Client chooses to terminate this Agreement, the Client will be required to compensate the Artist. Regardless if the Artists commissioned work is completed or not. The Client shall forfeit any deposits paid.

A violation of these Terms will result in an immediate cancellation of your commission request and may result with not using our services in the future.


Payment:

  • Payment is paid upfront after agreement is made. I will not begin until the initial full payment OR partial payment has been received.

Complex Designs:

  • Depending on the commission; additional fee's may be required.

  • Provide sketches or references

Process: Step by Step

  • A rough sketch will be sent to the client to review to undergo any desired changes. Once approved the final draft will be made.

  • Line art begins once the first step and final sketch draft is approved.

  • Colors, shading, and highlights are the final step.

  • Commissions are a first come first served basis. You will be added to a waitlist, depending on the current commission que.

  • Art style: Is semi-realistic and anime inspired. Please allow some room for Creative freedom.


III. Conduct:

  • If anyone knowingly provides any information of a false, untrue, inaccurate or incomplete nature will result in the suspension of Services, this member will be violating Agreement terms and will be refused any and all current or future services.

  • Furthermore, you herein agree NOT to make use of Courtzgarden's Services for the purpose of:

  1. Behavior resulting in the following is not tolerated; anything that shall be deemed harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, libelous, or invasive of another's privacy or which is hateful, and/or racially, ethically or otherwise objectionable;

  2. causing harm to minors in any manner whatsoever;

  3. impersonating any individual or entity, misrepresenting any affiliation with an individual or entity;


IV. Limitation of Liability and Warranty

  • You acknowledge, understand and agree that Courtzgarden shall not be liable for any direct, indirect, incidental, consequential, or special damages or losses whether tangible or intangible, resulting from authorized or unauthorized use of or access to our products or service.

  • Upon creating your personal account to access commission services that you provide a username, password, or email for are your responsibility. Courtzgarden is not responsible for any third party access to your account that may include Theft, Appropriation, or Misappropriation of your account. If this happens contact the website provider you made the account with and report this.
